    What is Chapter 7 Bankruptcy?

One of the most common types of bankruptcy, Chapter 7 is a liquidation bankruptcy where the court sells all of your non-exempt assets for cash that is then used to pay your creditors proportionate to their claim in bankruptcy. Chapter 7 bankruptcy is a fast and efficient way of dealing with unsecured debts, properly aged tax debts, and your personal liability for many other debts and obligations that you may have incurred.

One of the benefits of filing for Chapter 7 bankruptcy is that upon filing, the automatic stay is activated, preventing any creditor from taking any action to collect on a debt. The automatic stay prevents creditors, collection agencies, government entities and anyone else from pursuing you for money that you owe them.

The automatic temporary stay becomes permanent when you receive your discharge and is called the discharge injunction. It is important to have guidance from experienced attorneys so that you don’t find yourself embroiled in a dispute with your creditors preventing you from receiving your discharge and making the automatic stay permanent.
